Welcome to itrend, your go-to platform for buying and selling the latest trends and goods. These Terms and Conditions of Use (“Terms”) govern your relationship with the itrend application (“the App”) when you use our services.
Introduction
Welcome to itrend (“we,” “our,” “us”). Your privacy is important to us. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use the itrend mobile application (“the App”).
By creating an account or using itrend, you agree to comply fully with these Terms. If you do not agree with any part of these Terms, you may not use the App.
1. Account and Responsibility
You must be legally qualified (18 years or older) to create an account on itrend.
You are solely responsible for maintaining the security of your account and password.
Any activity that occurs under your account is your full responsibility.
You promise to provide accurate and correct information when registering and when listing products for sale.
You agree not to share your account credentials with any third party. itrend is not liable for any unauthorized access resulting from your failure to secure your login information.
2. Payments and Transactions
For Physical Goods (Products, Clothing, Electronics, etc.)
All payments for physical products (whether itrend Direct Goods or Third-Party Seller Goods) are processed through itrend’s integrated payment gateway (e.g., Stripe, PayPal, or local bank transfer).

Google Play Billing is NOT used for any purchase of physical goods.

Apple In-App Purchase is NOT used for any purchase of physical goods.
This complies with both Google Play and Apple App Store policies, which allow external payment methods for physical goods and services performed outside the app.
For Digital Goods (if applicable in the future)
If itrend ever offers digital content, subscriptions, virtual currency, or premium app features:

On Android (Google Play): Must use Google Play Billing.

On iOS (Apple App Store): Must use Apple In-App Purchase.
You acknowledge that itrend is solely responsible for all payment disputes, refunds, and chargebacks related to transactions initiated through the App. Neither Google nor Apple handles refunds for physical goods purchased through this app.
3. Nature of Goods and Seller Identification
itrend operates a hybrid marketplace model. This means:

Some goods listed on the platform are owned and sold directly by itrend (“itrend Direct Goods”).

Other goods are owned and sold by independent third-party sellers (“Third-Party Seller Goods”).
Clear Seller Identification
For every product listing, the identity of the seller will be clearly displayed.
The seller’s name (e.g., “itrend” or the independent seller’s username) will be shown prominently on the product page.
You can always identify who you are buying from before completing a purchase.
Our Role

For itrend Direct Goods: We act as the direct seller and are fully responsible for the listing, sale, and fulfillment of the warranty as outlined in these Terms.

For Third-Party Seller Goods: We operate as a digital platform connecting sellers with buyers. We do not own these goods, do not directly control transactions between users, and do not assume direct responsibility for the quality or condition of these goods unless otherwise stated in our warranty policy.
4. itrend Warranty Policy
At itrend, we care about your satisfaction. Therefore, we have established a clear warranty policy suitable for each product:
A. Used Items

Warranty Period: itrend guarantees used items for one full day (24 hours) starting from the moment you confirm receipt of the product.

What the Warranty Covers: Hidden defects that were not apparent upon receipt and were not disclosed by the seller in the description.

What the Warranty Does Not Cover: Damage resulting from misuse, visible or previously mentioned defects, or any defects that appear after the 24-hour period.
B. New Items

Warranty Period: Varies by product. The seller must clearly and explicitly state the specific warranty period (e.g., one week, 6 months, one year) on the product page.

What the Warranty Covers: Manufacturing and material defects that appear during the announced warranty period.

Warranty Conditions: You, as a customer, must keep the invoice and report any defect to the seller within the warranty period.
5. Warranty Claim or Return Procedures
Direct Contact: You must notify the seller within 12 hours of discovering the defect via the chat system within the itrend app.
Documentation: Provide clear photos or a video showing the problem.
Timeframe for Used Items: Any problem with a used item must be reported within 24 hours of receipt.
Dispute Resolution: The seller and buyer cooperate to find a solution (repair, replacement, or return). itrend may intervene as a mediator if necessary to ensure fairness.
Cases Involving itrend as Seller: For goods sold directly by itrend, our dedicated customer service team will handle all claims and resolutions in accordance with these Terms.
6. User Conduct and Prohibited Content
(Apple and Google both require strict anti-harassment and anti-abuse policies)
As a buyer or seller on itrend, you agree that you will not:

Post false, misleading, or inaccurate information about any product.

Use the chat system to harass, threaten, bully, intimidate, or abuse another user.

Share personal contact information (phone number, email, WhatsApp, etc.) before a transaction is completed to avoid platform fees.

Upload content that is defamatory, obscene, or violates any applicable law.

Post content that infringes on any third party’s intellectual property rights (including copyright, trademark, or patent).

Post hate speech, discriminatory content, or content promoting violence against any group based on race, religion, gender, sexual orientation, or disability.
Reporting Violations
If you believe another user has violated these rules, you must report them to itrend immediately via the in-app “Report” button or by emailing [support@itrend.com].
itrend reserves the right to suspend or permanently ban any user who violates these conduct rules.
7. itrend’s Prohibited Items
(Expanded for both stores – Apple is especially strict on certain categories)
To foster trust and safety, itrend prohibits the listing of:

Counterfeit, replica, or stolen products.

Any materials that violate local laws or public morals.
-
Products that are misleadingly or inaccurately described.
-
Firearms, weapons, ammunition, or explosive devices (including replicas).
-
Illegal drugs, drug paraphernalia, or psychoactive substances.
-
Tobacco, e-cigarettes, vaping products, or alcohol.
-
Prescription medications or medical devices without proper licensing.
-
Adult content, pornography, nudity, or sexual services (Apple strictly bans this).
-
Live animals or endangered species products.
-
Services that require a professional license (e.g., legal, medical, financial advice) without proof of license.
-
Products that promote eating disorders, self-harm, or suicide (Apple and Google both prohibit this).
-
Real money gambling, casinos, or lottery services without proper licensing.
Any user listing prohibited items will have their account immediately terminated and may be reported to relevant authorities.
8. Intellectual Property
itrend’s Rights: The App’s name, logo, design, and code are owned by itrend and protected by copyright and trademark laws. You may not copy, modify, or reverse-engineer any part of the App.
User Rights: You retain ownership of any images or descriptions you upload to the App. However, by uploading content, you grant itrend a non-exclusive, royalty-free, worldwide license to display, store, and distribute that content solely for the purpose of operating the App.
Copyright Infringement (DMCA Notice)
If you believe your copyrighted work has been copied on itrend without permission, please email [support@itrend.com] with:

The URL or location of the allegedly infringing content

A statement under penalty of perjury that you own the copyright
itrend will respond to all valid DMCA notices within 5 business days and will remove infringing content.
9. Liability of itrend
For Third-Party Seller Goods: itrend App shall not be held liable for any losses or damages arising directly from a dispute between the seller and the buyer outside the scope of the warranty policy mentioned above.
For itrend Direct Goods: itrend, as the direct seller, assumes full seller liability as outlined in these Terms and applicable consumer protection laws.
Platform Liability: Regardless of the seller, itrend’s liability as a platform is limited to the responsibilities explicitly defined in these Terms.
Force Majeure: itrend is not liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, government actions, or internet outages.
10. Indemnification
You agree to indemnify, defend, and hold harmless itrend, its founders, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of these Terms

Your violation of any third party’s rights (including intellectual property or privacy)

Any dispute between you and another user of the App
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of [Your Country/State] .
Informal Resolution

Binding Arbitration

You waive your right to participate in a class action lawsuit against itrend.
12. Modification of Terms
itrend reserves the right to update these Terms at any time. You will be notified of any changes through the App via a pop-up notification or email.
Your continued use of itrend after such changes signifies your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the App and delete your account.
